CHALAND PUPPY GUARANTEE AND PURCHASE AGREEMENT

Chaland K9, LLC, owned by Angela Chamberlain, hereafter known as “Breeder” or "Chaland" and __________________________________________, hereafter known as “Buyer” enter into this agreement for the Purchase of a Belgian Malinois puppy.

Both Parties enter into the following agreement:

  1. Temperament. Many things affect a dog’s temperament. While effort has been made to assure that our puppies are produced from sound, healthy parents, we cannot guarantee puppy temperament due to factors beyond our control (i.e., future environment, training, etc). At this time, puppy displays no behaviors that cause concern. Buyer agrees that puppy temperament is acceptable.

  2. Health. Puppy has been checked by Strafford Vet on ___8/5/2023______. It is recommended that Buyer has the puppy checked by their own veterinarian within a 72 hour period. At vet checks puppy’s testes were descended (if male). Otherwise, no guarantee is made to puppy's future ability to reproduce. [Initials on pages 1, 2, 3,  with signatures on page 4].

Chaland knows of no known contagious diseases that the puppy/dog has been exposed to

within the past 21 days and the dog does not appear clinically ill from parasitic infestations.

 

If, within 4 days of purchase, Buyer's veterinarian deems this puppy to be suffering from a congenital defect, Buyer earns the right to choose from one of the following options:

 

  1. Puppy may be returned, with all paperwork signed to Chaland, for another puppy of equivalent value out of the same litter (if available) or the next litter produced by Chaland.

  2. If the Buyer so chooses, they may keep the original puppy and receive a second puppy out of the next litter produced by Chaland, after proof of original puppy's spay/neuter has been provided to Chaland. 

 

Proof of the examination and decision must be provided, in writing, with accompanying medical documents (such as Xrays), to Chaland at the address provided above. Verification by Chaland's veterinarian may be required before guarantee is honored. Any costs related to return of original puppy to Chaland will be paid for by Buyer.

 

Note: A diagnosis of Giardia, Coccidiosis, parasites, kennel cough or any other types of bacterial infection does not render your puppy unhealthy.

 

  • 3.Return of Puppy. Choosing to accept the puppy and then later changing one’s mind, for any reason, at any point in its lifespan, will not entitle one to a refund of any type, monetary or otherwise. Puppy must be returned to Chaland with any paperwork (including AKC registration certificate signed back over to Chaland) and any costs incurred due to return of puppy to Chaland, will be paid for by Buyer. Buyer will not be reimbursed for any expenses incurred while puppy was in co-owner’s care. It is also agreed that if this puppy cannot be kept by the Buyer, for any reason, it will be returned to Chaland. This puppy (and its offspring if it is breeding quality) will never be sold or given to puppy brokers, puppy mills, or animal control facilities. Should Chaland refuse to accept the return of the puppy, a written refusal will be provided as proof of refusal.

 

4. Hip/Elbow/Eyes/Echocardiogram Guarantee. This puppy is warranted to receiving a passing hip grade of Excellent, Good, or Fair from the Orthopedic Foundation for Animals (OFA) at 2 years of age and a passing elbow grade of “Normal” from the OFA at 2 years of age, unless adverse environmental circumstances have damaged the puppy's hips/elbows. Adverse environmental circumstances include, but are not limited to, being overweight, injury sustained due to excessive jumping, falling, or running before 18 months of age. If puppy has sustained some type of physical injury to the hips/elbows due to Buyer negligence, this guarantee will be void. The puppy is warranted to have a normal echocardiogram when performed at 2 years of age, which is to be registered with the OFA by buyer. The puppy is warranted to have a normal eye exam at 2 years of age. All costs associated with health testing and registering health tests with the OFA are the responsibility of the buyer. However, if this puppy does not pass OFA Hips/Elbows/Eyes/Echocardiogram examination at 2 years of age, through no fault of the Buyer, the Buyer earns the right to:

 

  1. Puppy may be returned, with all paperwork signed back to Chaland, for another puppy of equivalent value out of the next litter produced by Chaland.

  2. If the Buyer so chooses, they may keep the original puppy and receive a second puppy out of the next litter produced by Chaland, after proof of original puppy's spay/neuter has been provided to Chaland. 

The Hip/Elbow guarantee on this puppy will be null and void if the puppy is bred prior to 2 years of age, without having met the below requirements that are required for breeding, and/or while having a limited registration designation. Chaland may require a repeat on the puppy’s testing, completed by a veterinarian deemed appropriate by Chaland, before guarantee is fulfilled.

 

5. Ear Guarantee. This puppy's ears are guaranteed to stand by 1 year of age. If at 4 months of age the puppy's ears are not standing, Chaland MUST be contacted and Buyer agrees to follow Chaland's recommendations for ear posting and dietary supplementation. If ears still fail to stand by 1 year, after following recommendations of Chaland, then the Buyer earns the right to:

            A. Puppy may be returned, with all paperwork signed back to Chaland, for another puppy of                 

                 equivalent value out of the next litter produced by Chaland.

            B. If the Buyer so chooses, they may keep the original puppy and receive a second puppy out of

                 the next litter produced by Chaland, after proof of original puppy's spay/neuter has been

                 provided to Chaland.  

 

6. Microchip Information. Each Chaland puppy is microchipped and the chip is registered. The chip information has been provided in the puppy packet. Chaland will remain on the chip’s registered contact information and Buyer will also be added to the chip’s registered contact information.

7. Registration. Each Chaland puppy is registerable with the American Kennel Club and will be registered by Chaland. The puppy’s registered name will not be changed. Buyer is welcome to call the puppy any “call” name but will not attempt to edit the registered name of the puppy.

8. Limited versus Full Registration. If this puppy is sold on a limited registration, the limited status can be removed (giving full registration) if the puppy meets the following requirements:

  1. Has No Disqualifying Fault per the AKC Standard.

  2. OFA has designated the puppy's hips AND elbows to be passing grade at 2 years (or later) of age.

  3. OFA has a passing “normal” eye exam on file, performed at 2 years (or later) of age.

  4. OFA has a passing “normal” echocardiogram on file, performed at 2 years (or later) of age.

  5. Puppy has obtained at least 1 AKC title in conformation or a companion or performance event (CGC, Farm Dog Certification, Fast CAT, and Trick Dog titles are not accepted as a title for these purposes) OR puppy has obtained working certification with an acceptable entity OR puppy has obtained a sport title with an acceptable entity.

 

If a puppy has FULL registration, the puppy still cannot be bred until the puppy meets the following requirements:

  1. OFA has designated the puppy's hips AND elbows to be passing grade at 2 years (or later) of age.

  2. OFA has a passing “normal” eye exam on file, performed at 2 years (or later) of age, for this puppy.

  3. OFA has a passing “normal” echocardiogram on file, performed at 2 years (or later) of age, for this puppy.

  4. Puppy has obtained at least 1 AKC title in a conformation or a performance event (CGC, Farm Dog Certification, Fast CAT, and Trick Dog titles are not accepted as a title for these purposes) OR puppy has obtained working certification with an acceptable entity OR puppy has obtained a sport title with an acceptable entity. Chaland reserves the right to determine which entities and titles are accepted.

  5. Puppy will be bred to an AKC registered Belgian Malinois or a Belgian Malinois registered by an FCI recognized registry that meets all the qualifications (F-I) above.

9. Repossession of Puppy Due to Neglect or Abuse. Buyer agrees that Chaland may repossess puppy upon evidence of neglect or abuse to puppy, which has been verified by a third party. Paperwork will be returned, signed over to Chaland, from the Buyer.

10. Annual Check In. The Buyer understands that every litter produced by Chaland and every puppy in every litter has occurred because of Chaland’s love for and commitment to the breed. As such, the Buyer agrees to provide an annual update to Chaland to let Chaland know that the dog is in the Buyer’s home, along with details pertaining to the puppy’s temperament, health, working ability, and conformation to the written breed standard (AKC/FCI).

11. Default of this Agreement. This agreement will be strictly enforced by the Breeder. Failure to abide by this agreement will constitute “default” of this agreement.
